7 Years for Driver in Crash that Killed St. Charles Couple

Alia Bernard, 27, was sentenced Wednesday by a Kane County judge.

 

An Aurora woman was sentenced Wednesday for the 2009 crash in which a St. Charles couple was killed.

Alia N. Bernard, 27. of the 1500 block of West Galena Boulevard, Aurora, received a sentenced of seven years in Illinois prison from Kane County Judge Allen M. Anderson.

Bernard pleaded guilty to two counts of aggravated DUI on Dec. 9—one count for each person killed in the crash. Test results showed Bernard had marijuana in her system when the crash occurred, according to authorities.

On Wednesday, Bernard received a seven-year sentence for each count, terms she will serve concurrently.

Wade Thomas, 44, and the passenger on his motorcycle, his wife, Denise Thomas, 45, both from St. Charles, were killed in the May 23, 2009, crash.

According to authorities, a 1999 Toyota Solara driven by Bernard rear-ended another vehicle waiting on Route 47 near the intersection of Smith Road in rural Elburn. This started a chain-reaction involving two other vehicles that were stopped ahead of the vehicle Bernard's Solara struck, pushing one of the vehicles into the path of oncoming motorcycles traveling on Smith Road. Thomas' 2000 Harley-Davidson Softtail struck one of the vehicles.

Bernard is required at least 85 percent of the sentence, according to Illinois law.

Kane County Assistant State’s Attorney Jody Gleason prosecuted the case.

Justice, but an incredibly hard lesson to learn...only hope others heed these consequences. Being on a motorcycle is hard enouogh, but having to deal with impaired drivers is unconscionable. Hats off to the judge...sympathies to the Thomas'.

Not justice! She wasn't impaired and the prosecutors even admitted that. Smoking pot two days earlier has absolutely zero effect on driving. Illinois should be embarrassed about the new law they passed in April that put Bernard in jail for seven years. If you drink three beers two days before driving are you impaired? Justice isn't served just because someone goes to jail for seven years for the Thomas' deaths. IT WAS AN ACCIDENT! The real distraction involved here is that she was potentially texting when the crash occurred ..... but there is no proof of that. There IS proof that Bernard was NOT impaired at the time of the crash because there were such trace amounts of marijuana in her bloodstream, yet they sentenced her as if she was. I cannot believe this verdict and Judge Anderson should be ashamed of himself for putting a woman behind bars for seven years when there is absolutely zero proof that Bernard crashed because of the pot she smoked two days earlier. Do the lawmakers in this state even know how pot affects the brain and body. Evidently not, and their ignorance is putting people in jail when they shouldn't be. Yes, it was her fault because anyone who rear-ends another car is ALWAYS at fault, but what does the pot have to do with it? IT WAS AN ACCIDENT! What an absolute joke!
