Judge Rules Charge in 2009 Crash that Killed St. Charles Couple is Constitutional

An attorney for Alia Bernard had asked a Kane County judge in August to kick the charge.

A has upheld the constitutionality of a charge against the driver involved in a 2009 crash that killed a St. Charles couple.

Specifically, the judge ruled on Friday concerning a new law that upgrades DUI charges for drivers with even the smallest amount of drugs involved, according to The Beacon-News.

The 27-year-old Aurora woman is charged with two counts of aggravated DUI and reckless homicide. The charges stem from an Elburn crash in which Wade and Denise Thomas of St. Charles died from injuries, according to prosecutors. 

In August, Bernard’s attorney asked the judge to declare the aggravated DUI charge unconstitutional.
