The officer at the scene then pulled out his Taser and reportedly told Byrd to leave again. After he refused again, the officer discharged the device, striking him in the chest and causing him to fall to the ground. After the officer lifted him up, Byrd allegedly refused to place his hands behind his back and the officer again discharged the Taser.

It was during this second attempt to arrest Byrd, who was on the ground, the resulted in the Taser activating accidentally while the officer was attempting to cuff him. According to the report, a subject in the area bumped the officer and that caused the discharge.
