St. Charles Plan Commission Chair Sued over Traffic Incident

Police ticketed Wallace after June incident.

A 66-year-old Wasco woman has filed a lawsuit against Chairman Todd Wallace stemming from a June traffic incident downtown, court records show.

Darlene Mitson claims 36-year-old Wallace was negligent when he made a right turn and struck her just before 9 p.m. on June 24 near First and Main streets. Mitson claims she was in the intersection with the walk signal when she was hit, the lawsuit states.

Wallace was served with the last month, but he has not filed a formal response as of yet. No attorney has filed an appearance for Wallace in the case, which is scheduled for a March hearing.

Police ticketed Wallace for failure to yield to a pedestrian and failure to provide aid or information after the incident, according to court records. The case was in court Thursday and is scheduled to come back Feb. 16.

A call to Wallace’s attorney, Gary Johnson, was not immediately returned on Thursday.

In September, Johnson issued a subpoena to obtain the woman’s medical records for the months immediately following the incident, but prosecutors objected on privacy grounds, court records show. In the filings, prosecutors suggest the defense wanted medical information to attack the woman’s credibility due to her level of intoxication.

It is unclear in court records whether the judge ruled on the motion to quash the subpoena.
