South Elgin Man Charged with Public Indecency at Mall

A South Elgin man was arrested Aug. 16, 2013 at the Charlestowne 18 Theatres, 3740 E. Main St., on charges of public indecency and disorderly conduct after he was seen masturbating in the upper level over the theater’s box office area.


Kenneth Ray Rutherford, 70, of the 200 block of West Quarry Street, South Elgin, posted $150 cash bond and was released pending an Oct. 3, 2013 court appearance.


According to police, St. Charles police were called to the theaters, located in the Charlestowne Mall, where officers met with the complaining witness who is the manager of the theaters. Police took Rutherford into custody without incident at 2:13 p.m.
