A lawsuit alleges the experimental kit plane in which Kane County Bar Association member Kim Presbrey crashed was unfit for flying.
The estate of a Kane County lawyer is suing the companies that designed and built the experimental kit plane that crashed in Florida more than a year ago and ultimately resulted in the death of Kim Edward Presbrey. The lawsuit was filed in Cook County Circuit Court in connection with the April 2012 private-plane crash in DeLand, FL, north of Orlando where Presbrey was piloting his Seawind 3000 aircraft. Lawyers claim the Seawind "suddenly and unexpectedly lost power" shortly after takeoff and crashed into a local supermarket. Both Presbrey and his passenger suffered severe burns; the passenger survived but Presbrey, who was 60, died after about a month in intensive care. MONDAY, MAY 20, 2013 An 86-year-old resident of the 200 block of Chasse Circle reported at 11:38 a.m. an incident of attempted wire fraud. The woman told police she had received a call that caller ID stated originated in Kingston, Jamaica, and that the caller, who had a thick accent, tried to convince her she had won a prize, ranging from $100,000 to $1 million, from the Publishers Clearinghouse sweepstakes. The caller said that to claim her prize, the woman would have to pay a fee, and instructed her to go to Walmart and purchase a Green Dot MoneyPak cash card, load the card with the required fee, and call a number where the fee would be processed. The Geneva Fire Department is investigating the cause of a fire that resulted in about $30,000 damage to a home at 1050 Division Street in the wee hours of Thursday, May 23. Firefighters were dispatched to the home around 2:01 a.m. after a 911 report of a fire in the attached garage. Firefighters saw smoke coming from the garage, located the fire and contained it to the garage, according to a Geneva Fire Department press release issued Thursday by Deputy Chief Mark Einwich. Residents of the two-story home were inside at the time but were able to exit the building unharmed. There were no injuries to fire personnel on the scene. One firefighter was taken to Delnor Hospital after fighting the blaze that caused $200,000 damage Wednesday to a Batavia home on Ekman Drive, according to a Batavia Fire Department press release issued around 8:35 p.m. Wednesday, May 22. The injured firefighter is unnamed in the press release, but a Kane County Chronicle article says the injuries were not life-threatening and likely heat-related. Delnor's Multi-Sports Madness on Sunday and the Memorial Day parade on Monday will close some streets near the Delnor Hospital campus and in downtown Geneva.
The Geneva Police Department is alerting area drivers to two weekend events that will have an impact on local traffic. The Delnor Multi-Sport Madness Triathlon will be run in the area of the Delnor campus, requiring the closure of some roads from about 7 a.m. to 9 a.m. Sunday, May 26. During that time, the city will close Williamsburg Avenue west of Randall Road, Fisher Drive from Heartland Drive to Bricher Road and Bricher Road from the western entrance of the Geneva Commons to Peck Road. Police officers and volunteers working the event will help residents in that area come and go to their residences as quickly as they are able. Batavia, Geneva and other area firefighters battled a blaze on the rooftops of a Batavia home on Ekman Drive after a lightning bolt smashed through its roof shortly after noon Wednesday, May 22. The fire is at a home at 932 Ekman Drive, just west of Ekman's intersection with Raddant Road. The home is located just north of a neighborhood park. The family claims Eden should have taken steps to protect residents.
The family of the 50-year-old victim of a murder-suicide in October is suing the Eden Supporting Living Center in North Aurora, where she was killed. According to a report in The Beacon-News, the family of Tomi Vandiver is saying the assisted living community should have expelled her boyfriend and suspected murder, 58-year-old Jon Neel, because of his previous violent history. Vandiver was stabbed to death Oct. 29, 2012, in the living center at 311 S. Lincolnway St., North Aurora. Neel died when he jumped out of a third-story window on that same day. Vandiver had a romantic relationship with Neel, according to an initial investigation. She went to his apartment to gather some of her things early in the evening on Oct. 29 before she planned…

Sadly, Ralph Lowe of Batavia is pronounced dead at Delnor Hospital.
The 81-year-old driver of a 2000 Volvo that collided Monday morning with a Mercury at Mill Street and Randall Road died later that day, police reported Tuesday. Batavia police Detective Sgt. Shawn Mazza said Ralph Lowe, 81, of Batavia was pronounced dead at Delnor Hospital. Lowe's Volvo was westbound on Mill Street approaching Randall Road at around 10:08 a.m. Monday, May 20, when it went through the red light at the intersection and was struck by a northbound 2003 Mercury driven by Vincent Perna, 20, of South Elgin. Mazza said several witnesses corroborated the report that the light was green on Randall Road at the time of the crash. Perna also was injured in the accident and transported to Delnor Hospital.
